§ 106-42. Establishment of planning communities.

  • (a)

    Establishment. The county hereby establishes and divides the unincorporated portion of the county into 12 planning communities in order to review in a comprehensive, systematic, manageable and timely manner, any zoning district on unimproved property that is inconsistent with the growth management plan. Each planning community shall be the subject of a single comprehensive zoning district amendment (rezoning) under section 106-43, except as provided herein. The boundaries of each of the 12 planning communities shall substantially conform to the map attached to Ordinance 90-23 as exhibit 1. The 12 planning communities shall be identified and described as follows:

    North Naples (Planning Community No. 1).

    (2)

    South Naples (Planning Community No. 5).

    (3)

    East Naples (Planning Community No. 4).

    (4)

    Central Naples (Planning Community No. 2).

    (5)

    Royal Fakapalm (Planning Community No. 7).

    (6)

    Marco Island (Planning Community No. 6).

    (7)

    Urban Estates (Planning Community No. 9).

    (8)

    Rural Estates (Planning Community No. 8).

    (9)

    Big Cypress (Planning Community No. 12).

    (10)

    Corkscrew (Planning Community No. 10).

    (11)

    Golden Gate (Planning Community No. 3).

    (12)

    Immokalee (Planning Community No. 11).

    (b)

    Rezoning sequence. All unimproved properties located in each planning community shall be subject to consistency determinations, rezoning pursuant to the zoning reevaluation program, and, if applicable, exemptions, compatibility exceptions and determinations of vested rights. All inconsistent, nonexempt, unimproved property located in a single planning community shall be the subject of a single comprehensive zoning district amendment (rezoning), except as provided herein. Such comprehensive rezonings shall be on a planning community by planning community basis, commencing with all inconsistent, nonexempt, unimproved properties for the first planning community (North Naples), then all inconsistent, nonexempt, unimproved properties for the second planning community (South Naples), and proceeding successively, until all 12 planning communities have been comprehensively rezoned pursuant to the zoning reevaluation program in section 106-43, unless otherwise determined by the board of county commissioners.
