§ 26-172. Additional operational provisions.
(a)
Every sexually-oriented business shall, regardless of whether or not said business is permitted under this article, observe the following general requirements:
(1)
Conform to all applicable building statutes, codes, ordinances and regulations, whether federal, state or local;
(2)
Conform to all applicable fire statutes, codes, ordinances, and regulations, whether federal, state or local;
(3)
Conform to all applicable health statutes, codes, ordinances, and regulations, whether federal, state or local;
(4)
Conform to all applicable zoning regulations and land use laws, whether state or local;
(5)
Maintain a continuously updated compilation of the records required in section 26-164 and, on the first Monday of every month, provide the division with an update of those records for all persons who are, or have been, employees at the business since the first Monday of the previous month, and their positions.
(b)
No permittee/operator may change the name of a sexually-oriented business unless and until he satisfies each of the following requirements:
(1)
Gives the division 30 days notice in writing of the proposed name change;
(2)
Pays the division a $3.00 change of name fee; and
(3)
Complies with F.S. § 865.09.
