§ 262-57. Same—Transmission, appointment of commissioners.

Within 30 days after the adoption of the plan of reclamation and improvement, the
secretary of the board of supervisors shall prepare and transmit a certified copy
thereof to the clerk of the circuit court of the county in which the larger part of
said drainage district is located, and at the same time the board of supervisors shall
file with said clerk a petition asking the judge of said court to appoint three commissioners
to appraise the lands within and without said district to be acquired for rights-of-way,
holding basins, and other drainage works of said district, and to assess benefits
and damages accruing to all lands in said district by reason of the execution of the
"plan of reclamation and improvement," and immediately after the filing of such petition,
the judge of said court either in term time or vacation, shall make and enter an order
appointing three commissioners who shall be freeholders residing within the State
of Florida, and who shall not be landowners in said district, nor of kin by consanguinity
or affinity within the fourth degree to any person, owning land in said district.
The majority of said commissioners shall constitute a quorum and shall control the
actions and decisions of the board of commissioners on all questions.
